Lawsuit Complicates 'Stellar Blade' Name

A Louisiana-based film production company, Stellarblade, is suing Sony and Shift Up, the creators of the PS5 game Stellar Blade, for alleged trademark infringement. The lawsuit, filed earlier this month in a Louisiana court, claims that the game's title damages Stellarblade's business and hinders its online visibility.

Stellarblade, owned by Griffith Chambers Mehaffey, specializes in commercials, documentaries, music videos, and independent films. Mehaffey argues that the similarity between the names, including the stylized "S," causes confusion and prevents potential clients from finding his company online. He registered the "Stellarblade" trademark in June 2023, after sending a cease-and-desist letter to Shift Up the following month. He claims to have operated under the Stellarblade name and owned the stellarblade.com domain since 2006.

The lawsuit seeks monetary damages, attorney fees, and an injunction preventing further use of "Stellar Blade" or similar variations. Mehaffey also demands the destruction of all Stellar Blade marketing materials. His lawyer contends that Sony and Shift Up were aware of Mehaffey's established rights before adopting the similar name for their game, which was initially known as "Project Eve" before its 2022 rebranding. Shift Up reportedly registered the "Stellar Blade" trademark in January 2023.

Mehaffey’s legal team emphasizes the long-standing use of the Stellarblade name and domain, highlighting the impact of the game's superior online presence on their client's business visibility. They argue that the defendants' actions have created a virtual monopoly on search results for "Stellarblade," harming Mehaffey's livelihood. The lawsuit also points out the retroactive nature of trademark rights, suggesting that even though Shift Up registered their trademark earlier, Mehaffey's prior use could still provide legal grounds for the claim. The legal battle highlights the complexities of trademark disputes, particularly when dealing with similar names and significant differences in the size and reach of the involved companies.
